01 Who we are

This Privacy Policy is issued by CityTub Inc., a New York corporation with its principal office at 2225 60th Street, Brooklyn, NY 11204 ("CityTub," "we," "us," or "our").

This Policy governs the personal information practices of CityTub Inc. and all of its operating brands and "doing business as" (DBA) entities, including but not limited to:

  • New York Tubs — operating at nytubs.com, serving New York City, NY
  • WhiteTubs — operating at whitetubs.com, serving Chicago, IL
  • Any additional regional service brands subsequently established by CityTub Inc.

References in this Policy to "our website," "our services," or "our SMS program" apply to all CityTub Inc. brand websites and the unified SMS program operated under the CityTub Inc. brand registration.

02 Information we collect

Information you provide directly

When you request a quote, schedule a service, contact us, or opt in to receive SMS messages through any CityTub Inc. brand website, you may provide:

  • Name
  • Mobile or landline phone number
  • Email address
  • Service address
  • Details about the bathtub or fixture to be refinished (condition, photos, dimensions)
  • Payment information (processed through third-party payment processors; we do not store full card numbers on our servers)

Information collected automatically

When you visit a CityTub Inc. brand website, we may automatically collect basic technical information such as IP address, browser type, device type, referring URL, and pages viewed, through cookies and similar technologies (see Section 6).

03 How we use information

We use the information we collect to:

  • Provide bathtub refinishing, restoration, and related services you have requested
  • Schedule appointments and send appointment confirmations and reminders
  • Communicate with you about your service, including follow-up and customer care
  • Process payments for services rendered
  • Respond to inquiries, quote requests, and customer support questions
  • Send SMS messages to phone numbers you have provided and for which you have given consent (see Section 4)
  • Improve our websites, services, and customer experience
  • Comply with legal obligations and enforce our terms

04 SMS communications

CityTub Inc. operates a unified SMS messaging program across all of its DBA brand websites. This section describes how the program works, how you opt in, the messages you can expect to receive, and how you can opt out.

How you opt in

You opt in to receive SMS messages from CityTub Inc. in one of the following ways:

  • By submitting your mobile phone number through a booking, quote, or contact form on any CityTub Inc. brand website (including but not limited to nytubs.com and whitetubs.com) and affirmatively checking the SMS consent checkbox provided on that form;
  • By providing your mobile phone number directly to a CityTub Inc. representative during a service inquiry, phone call, or in-person consultation, and verbally consenting to receive SMS messages.

Consent to receive SMS messages is not a condition of purchasing any goods or services from CityTub Inc. or any of its DBA brands.

Types of messages you may receive

If you opt in, you may receive SMS messages from CityTub Inc. relating to:

  • Appointment scheduling, confirmations, and reminders
  • Service updates, technician arrival notifications, and completion notices
  • Quote and pricing follow-up
  • Customer service responses to inquiries you have initiated

Important SMS terms — required disclosures:

Frequency
Message frequency varies. Most customers receive between 1 and 5 messages per month, depending on the status of their service request.
Cost
Message and data rates may apply from your mobile carrier. CityTub Inc. does not charge a separate fee for SMS messages, but standard messaging and data rates from your carrier may apply to each message sent or received.
Help
Reply HELP to any message to receive help, or contact us directly at info@citytub.com or +1 (212) 830-0000.
Opt-out
You can opt out of SMS messages at any time by replying STOP, END, CANCEL, UNSUBSCRIBE, or QUIT to any message you receive. After you opt out, you will receive a single confirmation message and no further messages, unless you opt back in.
Carriers
Supported by major U.S. carriers including AT&T, Verizon, T-Mobile, and others. Carriers are not liable for delayed or undelivered messages.
Eligibility
You must be 18 years of age or older, and the account holder or authorized user of the mobile phone number provided, to consent to receive SMS messages from CityTub Inc.

SMS data sharing — no third parties

Mobile opt-in data and SMS consent — including your mobile phone number and your opt-in status — are not shared, sold, rented, or otherwise transferred to any third parties or affiliates for marketing or promotional purposes, under any circumstances.

We may share phone numbers solely with subprocessors (such as our telephony provider, currently Dialpad, Inc.) for the limited purpose of delivering the SMS messages you have requested. These subprocessors are bound by contract to use the information only to provide the messaging service and not for their own purposes.

Privacy of SMS content

The content of SMS messages exchanged between you and CityTub Inc. relates to your service and is retained by us solely for the purpose of providing customer service and maintaining accurate service records. SMS content is treated with the same confidentiality as other customer communications.

05 Sharing of information

We do not sell or rent personal information to third parties. We share personal information only:

  • With service providers — such as payment processors, scheduling software, telephony providers, and hosting providers — who process information on our behalf under contractual confidentiality and data-protection obligations;
  • With your consent — for example, if you ask us to share information with a third party;
  • To comply with law — when we believe in good faith that disclosure is required to comply with a legal obligation, court order, or government request;
  • To protect rights and safety — to enforce our terms, protect our property, prevent fraud, or protect the safety of any person.

As stated in Section 4, SMS opt-in data and mobile phone numbers collected for SMS purposes are never shared with third parties or affiliates for marketing or promotional purposes.

06 Cookies & analytics

Our websites use cookies and similar technologies to operate the site, remember preferences, understand how visitors interact with our content, and improve performance. We may use third-party analytics tools (such as Google Analytics or Yandex Metrika) which set their own cookies in accordance with their respective privacy policies.

You can disable cookies through your browser settings; doing so may affect the functionality of certain features of our websites.

07 Data security & retention

We use reasonable administrative, technical, and physical safeguards to protect personal information against unauthorized access, alteration, disclosure, or destruction. No method of transmission or storage is 100% secure, however, and we cannot guarantee absolute security.

We retain personal information only for as long as is necessary for the purposes set out in this Policy, to provide our services, to comply with legal obligations, to resolve disputes, and to enforce our agreements.

08 Your rights & choices

Depending on your jurisdiction, you may have the right to:

  • Access the personal information we hold about you
  • Request correction of inaccurate or incomplete information
  • Request deletion of your personal information, subject to certain exceptions
  • Withdraw consent for SMS messages or marketing communications at any time (see Section 4)
  • Object to or restrict certain processing

To exercise any of these rights, contact us using the information in Section 11. We will respond within the timeframe required by applicable law.

09 Children's privacy

Our services are intended for adults and are not directed at children under 18. We do not knowingly collect personal information from children under 18. If you believe a child has provided us with personal information, please contact us so we can delete it.

10 Changes to this policy

We may update this Privacy Policy from time to time. When we do, we will update the "Last updated" date at the top of this page. For material changes, we will provide additional notice (for example, by email or a prominent notice on our websites). Continued use of our services after a change becomes effective constitutes acceptance of the revised Policy.
